Legislation - Acts and Regulations

The regulation of building construction is a provincial government responsibility. The Federal Government has no legislative authority over building construction in Canada.

Building construction in Manitoba is regulated by The Buildings and Mobile Homes Act, The Fires Prevention and Emergency Response Act, The Planning Act, and local municipal bylaws. The acts and associated regulations are available on the Manitoba Laws website. Municipal bylaws are available from each municipality, and in many cases on the municipality’s website. Inspection and Technical Services Manitoba promotes safety awareness and encourage safe practices. The work of administering the following legislation makes Inspection and Technical Services Manitoba the authority in the design, construction, installation and operation of power and heating boilers, pressure vessels, pressure piping and refrigeration plants; elevators and elevating devices; gas- and oil-fired equipment; and amusement rides. In addition we qualify and license the tradespeople who install, maintain and repair this intrinsically hazardous equipment.

The Buildings and Mobile Homes Act:

The Buildings and Mobile Homes Act applies to the construction, erection, placement, alteration, repair, renovation, demolition, relocation, removal, occupancy or change in occupancy of any building or addition to a building. The Act requires municipalities in Manitoba to adopt and enforce the codes and standards established, adopted or enforced under the Act. In practice, this responsibility is shared by municipalities and the Office of the Fire Commissioner's Inspection and Technical Services Manitoba section.
